Welcome to Next Tutor! These Terms of Service ("Terms") govern your access to and use of Next Tutor's platform, which provides tools and services to help private tutors manage and grow their teaching business. By using Next Tutor, you agree to these Terms. Please read them carefully. If you do not agree, please do not use the Service.

1. Who We Are

Next Tutor is a standalone software-as-a-service (SaaS) platform (Web and Mobile) that provides private tutors with tools to manage their educational business efficiently, including:

  • A professional website (landing page)
  • Student management and progress tracking
  • Scheduling and calendar tools
  • Online payment tracking and deposit management
  • Messaging and communication tools
  • Automated reminders, analytics, and more

We are not a marketplace. We do not match students with tutors, nor are we a party to any agreement, contract, or transaction between a tutor and a student.

2. Eligibility

You may use Next Tutor if you:

  • Are at least 18 years old.
  • Are using the platform to manage a legitimate educational or tutoring business.
  • Can legally enter into binding agreements.

Because Next Tutor is available globally, you are solely responsible for ensuring your use of the platform complies with all local laws and regulations in your country, including tax laws and regulations regarding the collection of data from minors.

3. Your Account

You are responsible for:

  • Keeping your login credentials secure.
  • Ensuring your information is accurate and up-to-date.
  • All activity that occurs under your account.

You may not share your account with others without our written permission.

4. Data Ownership & Your Content

You own your data. You retain full ownership of all personal data, student records, lesson plans, files, and content you upload to the platform.

Our infrastructure. Next Tutor owns the software, the database infrastructure, and any aggregated, anonymous analytical data used to improve our services.

By using the Service, you grant Next Tutor a limited, secure license to host, display, and process your content solely to operate the platform. Legally, you act as the "Data Controller" for your students' data, and Next Tutor acts as your "Data Processor." You represent and warrant that you have all necessary rights and consents (including parental consent for minors) to upload your students' data to our platform.

5. Payments, Subscriptions & Transactions

Your Next Tutor Subscription: Next Tutor is a paid SaaS service. Subscriptions are processed securely via our designated third-party payment processor, PayPal. By subscribing, you authorize PayPal to charge your payment method on a recurring basis. You may cancel your subscription at any time. Cancellations take effect at the end of your current billing cycle. We do not offer pro-rated refunds for partially used billing periods unless required by law.

Student-to-Tutor Payments: You may use the platform to facilitate direct payments from your students to you via PayPal.

  • Next Tutor charges zero commission or fees on these transactions.
  • All payments for tutoring services are strictly between you and your student.
  • Next Tutor is not liable for any chargebacks, failed payments, refunds, or disputes between you and your students.

6. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes or to promote illegal acts.
  • Store or process sensitive student data without proper legal consent.
  • Circumvent our systems, security, or subscription limits.
  • Copy, reverse-engineer, or resell any part of the platform.
  • Use the platform to harass, spam, or mislead others.

Violation of these terms may result in immediate suspension or termination of your account without a refund.

7. Privacy

We are committed to protecting the privacy of our users and the data you store with us. Please review our Privacy Policy for detailed information on how we securely collect, process, and protect data.

8. Downtime and Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access. We may occasionally take the system offline for maintenance, upgrades, or due to unforeseen technical issues. Next Tutor is not liable for any lost revenue or inconvenience caused by platform downtime.

9. Intellectual Property

All platform content, software, design, and technology (excluding user-generated content) is the exclusive property of Next Tutor Ltd. or its licensors. You may not use our branding, logos, or software code without explicit written permission.

10. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your account if:

  • You breach these Terms.
  • Your subscription expires or payment fails.
  • We suspect abuse, fraud, or legal violations.

Upon termination, we will delete your data after a standard grace period, unless required by law to retain it. It is your responsibility to export your data prior to account deletion.

11. Disclaimer, Limitation of Liability & Indemnification

"As Is" Service: The Service is provided "as is" and "as available." We do not guarantee that it will meet all your needs or be entirely error-free.

Limitation of Liability: To the fullest extent permitted by law, Next Tutor is not liable for indirect, incidental, or consequential damages, including loss of income, lost data, or business interruption. Our maximum total liability to you will not exceed the amount you paid to Next Tutor for your SaaS subscription in the 12 months preceding the claim.

Indemnification: You agree to indemnify and hold harmless Next Tutor Ltd. from any legal claims, damages, or lawsuits (including attorney's fees) arising from your breach of these Terms, your tutoring services, or disputes between you and your students.

12. Governing Law & Jurisdiction

These Terms and your use of the Next Tutor platform shall be governed by and construed in accordance with the laws of the State of Israel. Any legal disputes or claims arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Tel Aviv, Israel.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes via email or an in-app notification. Your continued use of the platform after changes have been communicated means you accept the updated Terms.
